Article 1: Conclusion and Content of the Agreement
1.1 Offer and Acceptance
1.1.a. The agreement is concluded upon acceptance of the offer from Rentals Egmond by the tenant. After the agreement is finalized, the tenant will receive confirmation via email.
1.1.b. When booking online, the tenant is notified prior to confirming that they are entering into an agreement and which terms apply. By confirming the booking through Rentals Egmond, the tenant is bound by this agreement.
1.2 Withdrawal of Offer
The offer from Rentals Egmond is non-binding and may be withdrawn if necessary. Withdrawal due to calculation errors in the total rental price or other mistakes is permitted. This must be done as soon as possible, but within one week of the confirmation of acceptance, with reasons provided. In such cases, the tenant is entitled to a prompt refund of any payments made.
1.3 Obvious Errors
Obvious mistakes and errors do not bind Rentals Egmond. These are errors that should be clearly recognizable by the average tenant.
1.4 Check-In and Check-Out Times
Arrival and departure times are stated in the confirmation. Any deviations will be discussed with the tenant and confirmed via email or phone. In the event of unforeseen circumstances on the day of arrival (e.g., technical failure), Rentals Egmond reserves the right to change the arrival time. The tenant will be notified as soon as possible, preferably by phone.
1.5 Termination by Rentals Egmond Due to Unforeseen Circumstances
1.5.a. Rentals Egmond reserves the right to terminate the agreement immediately if the accommodation becomes unavailable. Possible reasons include the sale of the property, it becoming uninhabitable, or the owner's unexpected termination of the rental.
1.5.b. In such cases, Rentals Egmond will make every effort to provide alternative accommodation. Any price differences (higher or lower) will be settled accordingly.
Article 2: Rental Price and Payment
2.1 Rental Price
The rental price stated in the confirmation includes the gross rent, mandatory costs including tourist tax (per person per night), and any upgrades.
2.2 Deposit Payment
2.2.1 A deposit of 25% of the rental price is required at the time of booking. This must be paid within 7 days of the confirmation date. By paying the deposit, the tenant agrees to the terms and conditions.
2.3 Remaining Balance
2.3.1 The balance must be paid no later than 4 weeks before the arrival date. Failure to do so places the tenant in default.
2.4 Late Payment
If payment is not received on time, Rentals Egmond will send a free reminder, giving the tenant three calendar days to pay. If payment is still not received, the agreement is considered cancelled as of the default date, and cancellation charges (see Article 4) apply. Payments already made will be offset against these charges.
2.5 Last-Minute Bookings
If the booking is made within 4 weeks of the arrival date, the full rental amount must be paid immediately.
Article 3: Changes by the Tenant
Changes made by the tenant after the agreement has been finalized can be arranged in consultation with Rentals Egmond. Rentals Egmond reserves the right to refuse changes or to charge for any additional or reduced costs. If a change results in cancellation, Article 4 applies.
Article 4: Cancellation by the Tenant
Cancellation Fees
In the event of cancellation, the following fees apply:
Up to the 42nd day before arrival (exclusive): 25%
From the 42nd to the 28th day before arrival (exclusive): 60%
From the 28th day up to the arrival date: 90%
On the day of arrival or later: 100%
Article 5: Tenant Liability
The tenant is liable to Rentals Egmond for any loss or damage to the accommodation during the rental period, regardless of whether the damage was caused by the tenant, co-tenants, third parties, animals, or objects under their care.
Article 6: Complaints and Liability
6.1 Any issues or defects must be reported within 24 hours of discovery to Rentals Egmond.
6.2 Rentals Egmond is not liable for disturbances such as noise from nearby accommodations, construction, or renovations.
6.3 Rentals Egmond will notify building management of any issues with central installations but cannot be held liable for the consequences.
6.4 Rentals Egmond reserves the right to access the accommodation if necessary. Guests must permit this. Notice will be given when possible.
6.5 If a defect prevents reasonable enjoyment of the accommodation and is not the tenant’s fault, Rentals Egmond must be given the opportunity to resolve it, except in the cases listed in 6.2 and 6.3.
6.6 If a tenant feels a complaint is not resolved, Rentals Egmond will mediate with the property owner and may offer a financial arrangement on the owner's behalf.
6.7 If no agreement is reached, Rentals Egmond will provide the owner's contact details so the tenant can pursue further action if desired.
Article 7: Termination of the Agreement
7.1 Rentals Egmond may terminate the agreement and require immediate vacating of the accommodation if the tenant seriously violates their responsibilities (e.g., causes damage, exceeds occupancy, or creates nuisance). In such cases, no refund will be issued, and damages may be claimed.
7.2 If Rentals Egmond cannot provide the accommodation due to uncontrollable circumstances (see Article 1.5), the agreement may be cancelled. The tenant will receive a refund but cannot claim additional compensation. The owner will attempt to offer a suitable alternative.
7.3 The owner may be represented by Rentals Egmond in enforcing these rights.
